Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the TradeScenario software subscription and related services (the “Service”), including the website tradescenario.online and the Telegram bot @AiTradeConsultant_bot.

1. Acceptance of Terms

By (a) paying for a subscription, (b) activating a license key, (c) opening or using the Telegram bot, or (d) browsing tradescenario.online, you agree to be bound by these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction).
• You must comply with all laws applicable to you, including laws on digital services, taxes, and financial markets.
• The Service is not offered to persons in jurisdictions where use of the Service or related crypto trading tools would be unlawful. You are solely responsible for determining whether your use is legal.
• We may refuse, suspend, or terminate access at our discretion if we believe you are ineligible or in breach of these Terms.

3. Nature of the Service

TradeScenario provides access to software tools that may include, without limitation: market scanners, indicator-based signals, chart views, news summaries, volatility estimates, hypothetical stop-loss / take-profit levels, and illustrative position sizing based on parameters you or the software supply.

The Service is provided for informational and educational purposes only. Nothing in the Service constitutes a recommendation, solicitation, or offer to buy or sell any financial instrument, cryptocurrency, derivative, or security.

We do not:

• hold, custody, or control your funds;
• execute trades on your behalf (unless explicitly stated in a separate written agreement, which is not the default);
• manage your account or portfolio;
• provide personalized investment, financial, tax, or legal advice;
• guarantee accuracy, completeness, timeliness, or suitability of any output.

Any reference to “signals”, “scenarios”, “LONG”, “SHORT”, “SL”, “TP”, or similar terms describes analytical output only, not an instruction to trade.

4. Your responsibilities

• Independent decisions. You alone decide whether, when, and how to trade. You are solely responsible for evaluating the Service output and for all orders placed on any exchange.
• Exchange accounts. Your relationship with any exchange (e.g. Bybit) is solely between you and that exchange. You must comply with the exchange’s terms, API rules, and regional restrictions.
• API keys (optional). If you voluntarily submit exchange API credentials, you do so at your own risk. We strongly recommend read-only API permissions (no trading or withdrawal rights). You may revoke keys on the exchange at any time.
• Accurate information. You must provide accurate payment and contact information and keep your Telegram User ID correct at checkout.
• Security. You are responsible for securing your Telegram account, devices, and exchange credentials.
• Prohibited conduct. You may not: reverse engineer or scrape the Service; overload or attack our systems; resell or sublicense access without permission; share license keys; use the Service for unlawful activity; or misrepresent affiliation with TradeScenario.

5. Subscription, payment, and activation

• Access is sold as a prepaid software subscription for a fixed period (e.g. 30, 90, or 365 days) unless otherwise stated at checkout.
• Prices are shown on tradescenario.online or the payment page. Taxes may apply depending on your location and payment provider.
• Payments are processed by third-party providers (e.g. Stripe, Lemon Squeezy). We do not store full payment card numbers.
• After payment, access may be activated automatically via webhook or manually via a one-time license key (/activate KEY).
• Subscription grants software access only. It does not entitle you to any trading profit, signal accuracy, or future feature.
• We may change prices or features for future purchases. Changes do not retroactively alter an already paid period except as required by law.

Refunds are governed exclusively by our Refund Policy.

6. No financial advice; no fiduciary duty

TradeScenario and its operator are not registered as investment advisers, broker-dealers, commodity trading advisers, or similar regulated entities in any jurisdiction, and nothing in the Service should be construed as such.

No fiduciary, advisory, or special relationship is created between you and us. Our communications are general in nature and not tailored to your financial situation, objectives, or risk tolerance.

7. Disclaimers

AS IS / AS AVAILABLE. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.

NO GUARANTEES. We do not warrant that: (a) the Service will be error-free or uninterrupted; (b) signals or scenarios will be profitable; (c) market data will be real-time or complete; (d) the Service will meet your requirements; or (e) defects will be corrected.

THIRD-PARTY DATA. Market data, news, and exchange connectivity may be provided by third parties. We are not responsible for third-party errors, outages, or policy changes.

PAST PERFORMANCE. Any historical or illustrative performance is not indicative of future results.

8. Limitation of liability

To the fullest extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, trading losses, missed opportunities, exchange penalties, account freezes, or business interruption, arising from or related to the Service or these Terms, even if we have been advised of the possibility of such damages.
• Our total aggregate liability for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of: (a) the amount you paid us for the Service in the twelve (12) months preceding the claim, or (b) USD $50.
• Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless TradeScenario, its operator, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your trading activity; (c) your violation of these Terms or applicable law; (d) your exchange API usage; or (e) your violation of third-party rights.

10. Intellectual property

The Service, including software, branding, text, and design, is owned by the operator or licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service for personal use during an active subscription. You may not copy, modify, distribute, or create derivative works except as permitted by law.

11. Suspension and termination

We may suspend or terminate your access immediately if you breach these Terms, abuse the Service, or if required for security or legal compliance. Upon termination, your right to use the Service ends. Sections that by nature should survive (disclaimers, limitation of liability, indemnification, governing law) will survive.

You may stop using the Service at any time. Subscription fees are generally non-refundable except as stated in the Refund Policy.

12. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be posted on tradescenario.online with an updated “Last updated” date. Continued use after changes constitutes acceptance. If you do not agree, discontinue use and contact support regarding any prepaid unused period where applicable by law.

13. Governing law and disputes

These Terms are governed by the laws applicable to the operator of TradeScenario, without regard to conflict-of-law rules.

Before filing any formal claim, you agree to contact support@tradescenario.online and allow 30 days for informal resolution.

Where permitted by law, you agree that disputes shall be brought on an individual basis only, not as a class or representative action.

14. Miscellaneous

• Entire agreement. These Terms, Privacy Policy, Refund Policy, and Risk Disclosure constitute the entire agreement regarding the Service.
• Severability. If any provision is unenforceable, the remainder remains in effect.
• No waiver. Failure to enforce a provision is not a waiver.
• Assignment. We may assign these Terms; you may not assign without our consent.
• Force majeure. We are not liable for delays or failures due to events beyond reasonable control (e.g. outages, war, regulation, exchange blocks).
• Language. The English version of these documents controls.
